What does the 74-11 cover in the state of Michigan and what offense is it? What is the punishment for it? What if no prior drug convictions, however ten years prior the defendant had a conviction for assault.
Asked on 7/23/10, 6:11 pmIn short, 7411 covers first-time drug michigan offenders, such as a possession or use of marijuana. Sec 7411 of the Public Health code provides for a plea without conviction for a first offense on drug charges. If the Judge accepts him under 7411 and he completes a period of probation, the case is dismissed at the end of probation without a conviction on his public record. But that doesn't mean that certain government agencies won't see it.
